1. Acceptance of Terms
By accessing or using The Improv Collective ("the Site") at improvcollective.com, you agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Site.
We may update these Terms from time to time. Material changes will be posted on this page with an updated date. For significant changes, we will notify registered users by email at least 14 days in advance. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 13 years old to create an account on the Site. If you are between 13 and 18, you must have a parent or legal guardian’s consent to use the Site. By creating an account, you represent and warrant that you meet these requirements.
3. Accounts
When you create an account, you agree to:
- Provide accurate and complete registration information
- Maintain the security of your password and account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, engage in abusive behavior, or remain inactive for an extended period.
4. User Conduct
You agree not to:
- Post content that is unlawful, defamatory, harassing, hateful, sexually explicit, or otherwise objectionable
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
- Submit game descriptions or guides containing deliberately misleading, dangerous, or harmful instructions
- Post spam, chain letters, commercial solicitations, or unauthorized advertising
- Upload or transmit viruses, malware, or any code designed to disrupt, damage, or gain unauthorized access to the Site
- Attempt to access accounts, systems, or data not intended for you
- Scrape, data-mine, or systematically extract content from the Site using automated means (bots, crawlers, scrapers) without prior written permission
- Use the Site in any way that violates applicable local, state, national, or international laws or regulations
- Interfere with or disrupt the Site’s operation, servers, or networks
5. User-Generated Content
5.1 Your Content
You retain ownership of the content you submit to the Site, including comments, game submissions, shared resources, and profile information ("Your Content").
5.2 License to Us
By submitting Your Content, you grant The Improv Collective a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to:
- Display, reproduce, and distribute Your Content on the Site and in related promotional materials
- Modify Your Content for formatting, display, or accessibility purposes (without changing its substance)
- Use Your Content to promote the Site (for example, featuring a submitted game in a social media post)
For game submissions: if your submission is approved and published, it becomes part of the Site’s public game library. Other visitors may view, read, and use your game description. Your display name will be shown as the contributor. If you later delete your account, the game description remains in the library with attribution removed.
5.3 Your Representations
By submitting content, you represent and warrant that:
- You own or have the necessary rights, licenses, and permissions to the content
- The content does not infringe any third party’s intellectual property, privacy, publicity, or other rights
- The content complies with these Terms and all applicable laws
5.4 Content Moderation
We reserve the right, but have no obligation, to review, modify, or remove any user-generated content at our sole discretion. All comments are automatically sanitized using DOMPurify to remove potentially harmful HTML or scripts before display. We may remove content that violates these Terms, even if it has not been flagged by other users. We are not responsible for user-generated content, and views expressed by users do not represent our views.
6. Intellectual Property
6.1 The Site
The Improv Collective name, logo, site design, user interface, core game library data, and all original code are the property of The Improv Collective and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Site’s code or design without express written permission.
6.2 Game Content
Individual improv games and exercises are generally not copyrightable as ideas, concepts, rules, or procedures—only their specific written expression is protected. Many games on the Site are traditional improv exercises that have been passed down through the improv community and are in the public domain. Where games have been contributed by users, the contributor retains rights to their specific written description. The compilation, organization, and selection of the game library as a whole is protected.
6.3 DMCA Notice
If you believe content on the Site infringes your copyright, please send a notice compliant with the Digital Millennium Copyright Act (DMCA) to hello@improvcollective.com with the following information:
- A physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work claimed to be infringed
- Identification of the infringing material and information sufficient for us to locate it (URL or page description)
- Your contact information (name, address, phone, email)
- A statement that you have a good-faith belief the use is not authorized
- A statement under penalty of perjury that the information in the notice is accurate
We will respond to valid DMCA notices promptly and may remove or disable access to allegedly infringing material. We have a policy of terminating accounts of repeat infringers in appropriate circumstances.
7. Third-Party Links and Services
The Site may contain links to third-party websites, videos, or resources that are not owned or controlled by us. We are not responsible for the content, accuracy, privacy practices, or terms of any third-party sites. You access third-party links at your own risk, and we encourage you to review their terms and policies. The Site also integrates third-party services (see our Privacy Policy); your use of those services is subject to their respective terms.
8. No Professional Advice
All game descriptions, teaching guides, warm-up exercises, blog posts, glossaries, and other informational content on the Site are provided for educational and entertainment purposes only. They do not constitute professional advice (theatrical, educational, medical, legal, or otherwise). You should consult qualified professionals for advice specific to your situation. We make no representations about the suitability, safety, or effectiveness of any game, exercise, or technique described on the Site for your particular circumstances.
9. Physical Activity Disclaimer
Many improv games involve physical movement, vocal projection, and interpersonal contact. By using the Site and performing any described activities, you acknowledge and agree that:
- You are voluntarily participating in physical activities that carry inherent risks, including but not limited to muscle strain, falls, collisions, and other injuries
- You are solely responsible for assessing whether a particular game or activity is safe for your participants and environment
- You should ensure appropriate space, supervision, and safety measures when leading games, especially with children, seniors, or individuals with physical limitations
- We are not responsible for any injuries, damages, or losses resulting from participation in activities described on the Site
10. Disclaimer of Warranties
THE SITE AND ALL CONTENT, SERVICES, AND MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, THE IMPROV COLLECTIVE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content on the Site. You use the Site at your own risk.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE IMPROV COLLECTIVE, ITS OPERATORS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE, INCLUDING BUT NOT LIMITED TO:
- Physical injury or death resulting from performing improv activities described on the Site
- Loss of data, revenue, profits, goodwill, or business opportunities
- Damages resulting from interactions with other users
- Damages resulting from reliance on game descriptions, guides, or instructional content
- Damages resulting from unauthorized access to or alteration of your transmissions or data
Our total aggregate liability for any claim arising from your use of the Site shall not exceed the greater of (a) the amount you have paid us, if any, in the twelve months preceding the claim, or (b) one hundred U.S. dollars (USD 100.00). Some jurisdictions do not allow limitations on implied warranties or the exclusion or limitation of certain damages, so some or all of these limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless The Improv Collective, its operators, affiliates, officers, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:
- Your Content and its publication on the Site
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
- Your use of the Site or any activity related to your account
13. Dispute Resolution
13.1 Informal Resolution
We want to resolve disputes amicably. Before filing any formal legal claim, you agree to contact us at hello@improvcollective.com with a description of the dispute. We will work with you in good faith to resolve the issue informally within 60 days.
13.2 Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
13.3 Venue
Any dispute that cannot be resolved informally shall be resolved exclusively in the state or federal courts located in Los Angeles County, California. You consent to personal jurisdiction and venue in these courts. Notwithstanding this, either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights.
13.4 Time Limit
Any claim arising from these Terms or your use of the Site must be filed within one (1) year after the claim arises, or it is permanently barred.
14. Termination
You may terminate your account at any time from your profile settings. Upon termination:
- Your profile and associated personal data will be handled as described in our Privacy Policy
- Comments may be scrubbed or retained in anonymized form
- Approved game submissions remain in the public library with attribution removed
- Sections of these Terms that by their nature should survive termination (including but not limited to Sections 5–13 and 15–18) will survive
We may suspend or terminate your access to the Site at any time, with or without cause, with or without notice. Grounds for termination include violation of these Terms, extended inactivity, or at our reasonable discretion.
15. General Provisions
- Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.
- No Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us.
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Improv Collective regarding your use of the Site and supersede all prior agreements and understandings.
- Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations at any time without notice.
- Force Majeure: We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, or third-party service disruptions.
- Relationship: These Terms do not create any agency, partnership, joint venture, or employment relationship between you and us.
16. AI-Assisted and Human-Reviewed Content
We use artificial intelligence (AI) tools to help create some of the content on the Site, and we want to be transparent about how:
- Research: AI tools help us source and summarize perspectives and experiences from publicly available websites and blogs across the improv community.
- Human oversight: A human (currently a team of one) always reviews, synthesizes, designs, and approves our editorial content—including guides and game descriptions—before it is published. Because of this hands-on review, updates may take time.
- Artwork and written content: Some artwork and written content are produced with AI tools based on a concept and creative vision first conceived by a human.
While we work to keep content accurate and helpful, AI-assisted material may occasionally contain errors or omissions. Content is provided on the basis described in Section 8 (No Professional Advice) and Section 10 (Disclaimer of Warranties). If you spot something that looks incorrect, please tell us through our feedback form. As we grow, we hope to invite additional contributors to help create and review content for the community.
17. Advertising and Monetization
The Site is currently free to use. We aim to be transparent about how the project is supported financially:
- Advertising: We do not run third-party programmatic ad network scripts on the Site today. We may accept sponsor inquiries and may display direct sponsorships, partner resources, or affiliate links to help cover operating costs. Paid placements will be clearly disclosed where they appear, and any advertising partner data practices will be described in our Privacy Policy.
- Merchandise: We may offer merchandise to help support the business. Purchases would be fulfilled by a third-party commerce provider subject to its own terms.
- Third-party partners: We may collaborate with trusted partners in the improv space. Sponsored, affiliate, or paid relationships will be clearly disclosed where they appear.
- Editorial independence: Sponsors cannot buy teacher honor-roll inclusion, organic rankings, school rankings, or undisclosed endorsements. We may decline sponsors that do not fit the Site’s mission or community standards.
We do not sell your personal information. Your use of any third-party store, advertiser, or partner is subject to that party’s own terms and policies.
